Before various construction projects (e.g. landscaping, sewer, and water/wastewater work) may begin in the City of Canton, Georgia, the local Community Development Department may require a surety bond.

Landscape Establishment Bond (Performance and Maintenance Bond) - Required of landowners or developers that are applying for a certificate of occupancy from the Community Development Department. The bond limit must be equal to 150% of the estimated costs of the landscape installation and materials used. Once construction has been completed and approved by the Department, the developer must uphold the terms of the tree protection/landscape plan and regulations pursuant to the Development Code, as well as perform any maintenance needed (e.g. replacing unhealthy trees or any other vegetation installed). Failure to comply with the above stipulations may result in the Department filing a bond claim. The City shall use funds from the claim to cover the cost of bringing the development/landscape into compliance.
Sewer Maintenance Bond - Once a sewer facility project has been completed by a developer, the permit holder may be required by the Community Development Company to post a maintenance bond for a period of 18 months. The limit must cover the cost of the facility and materials used. Similar to most maintenance bonds, the permit holder is responsible for maintaining the work completed. Further details can be found in Chapter 111 of the Canton, GA Municode. The surety bond will act as a means of restitution to the Department should a breach of contract occur.
Water and Wastewater Right-of-Way Bond - Prior to water and wastewater construction in a public right-of-way area, the Community Development Department may require a surety bond of the developer in question. The bond limit is determined by the Department and is likely based on the estimated cost of the permit project. The developer must uphold all permit regulations pursuant to Chapter 114 of the Canton, GA Municode, and most importantly, restore the public right-of-way area to its original or a better condition once construction has been completed. If permit standards are not met, the Department may file a claim against the bond. Funds from the claim will go towards restoring the right-of-way and any other disturbances to the surrounding area.
