Subdivision Performance Bond - May be required of the developer by the Zoning Administration. The bond limit must be equal to 150% of the total construction costs for all paving, curbs, gutters, drainage systems, sidewalks, water systems, and sewage systems within the subdivision. The permit holder is responsible for following regulations, which include resolving any problems discovered by the Administration within 10 days of notice. Failure to comply may result in the Administration filing a claim against the developer’s bond.
Sidewalk Performance Bond - The terms and conditions of this surety bond are similar to the Subdivision Performance Bond when it comes to the required limit and permit regulations stated above. In addition, this bond applies to sidewalks in public right-of-way areas within the development and all construction must be completed within 18 months of the subdivision map being recorded. If a violation occurs, a bond claim may be filed by the Administration.
Development Maintenance and Warranty Bond - Upon completion of the development project and prior to the issuance of a Certificate of Occupancy, the Zoning Administration may require a maintenance/warranty bond of the permit holder. The bond amount must be equal to 50% of the total cost of the infrastructure improvements made. The developer is responsible for upholding permit obligations, following development regulations, and completing all maintenance requests made by the Zoning Administration. Failure to repair defective or deteriorated work within 30 days of notification can lead to the Administration filing a claim against the permit holder’s bond.
Landscaping Maintenance and Warranty Bond - Once all construction has been completed and an official Certificate of Occupancy has been issued by the Zoning Administration, a landscape/tree maintenance bond may be required of the developer for a period of two years. The bond limit must be equal in value to 100% of the total landscaping costs. Within this mandated period, the permit holder is to maintain the landscape and replace any unhealthy or dead trees upon notice from the Administration. Should the developer fail to fulfill all maintenance and warranty duties, a bond claim may be filed by the City.
