Probate is the legal process of distributing a person’s property after they pass away, ensuring their assets are distributed to the rightful heirs and any outstanding debts are paid. The person that handles this process is called a personal representative, specifically an executor or administrator. According to Tennessee Code 30-1-111 and 30-1-201, personal representatives must swear an oath and post a surety bond with the probate court judge. The Tennessee legislature enacted the surety bond requirement as a financial security for the estate's beneficiaries.

Terms to Know when it Comes to Tennessee Personal Representative Bonds

What is the Required Bond Amount?

Tennessee Code 30-1-201 et seq states that the bond amount for personal representatives must equal the full value of the estate, at a minimum. However, the required bond amount set by the court will be no greater than double the full value of the estate. 

The probate court overseeing your case will set the specific bond amount for each case and has the authority to increase or decrease the bond amount upon request of an interested party or at the court’s discretion.

Public administrators must also obtain a bond in an amount set by their county legislative body before beginning their fiduciary duties, according to TN Code 30-1-401.

To determine how much the bond will cost, personal representatives can follow the steps listed below:

  1. Determine the Required Bond Amount

The probate court judge determines the bond amount based on the fair market value of the estate’s assets listed on the initial application for appointment.

  1. Calculate the Total Cost

What Is the Process of Becoming a Personal Representative in Tennessee?

Step 1  – Determine Priority

Priority for appointment as a personal representative will be granted according to TN Code 30-1-106 in the following order:

Step 2 – Hire an Attorney

Although not explicitly required, we recommend that personal representatives hire an attorney to assist with the probate process.

Step 3 – Petition the Court

Anyone seeking to apply for administration of an estate must contact the probate court with jurisdiction to obtain their appointment. A representative of the court will walk the personal representative through the appointment process, provide them with all required forms, and answer any questions they may have. 

Personal representatives must submit a petition for appointment containing all the information outlined in TN Code 30-1-117 and should submit a formal death certificate along with the original will (if any) to the court. Additionally, personal representatives must include the fair market value of the estate’s property so the judge can determine the required bond amount.

Step 4 – Purchase a Surety Bond

Unless otherwise exempt, personal representatives must purchase and maintain a surety bond (exemptions outlined below).

What is the Purpose of the Tennessee Personal Representative Bond?

Tennessee requires personal representatives to purchase a surety bond as a prerequisite to being appointed as a fiduciary over an estate’s assets. The bond protects the estate's heirs, beneficiaries, and creditors from financial harm if the personal representative fails to abide by the regulations outlined in TN Code 30-1-201 et seq.

Specifically, the bond protects beneficiaries and creditors if the personal representative fails to adhere to all court orders or mismanages the estate’s assets. In short, the bond is a type of insurance that protects the interested parties of an estate if the personal representative violates their fiduciary duties.

Personal representatives in Tennessee have several key responsibilities in managing the probate process and settling the deceased person's estate. The primary duties are outlined in Title 30, Chapter 2 of the TN Code and include the following:

How Do You File a Personal Representative Bond with the Court?

Jet (the Surety) and the personal representative must sign the original bond. Jet fills out the bond form, signs as the Surety, and sends the original bond to the representative to sign and file the completed bond with the probate court. Jet will also send the representative an electronic copy of their bond for reference.

How Do I Renew the Tennessee Personal Representative Bond?

When you purchase the surety bond, you will immediately receive a digital version of your bond with a receipt. Afterward, Jet will complete the bond form, attach our raised seal, and mail it to you. You simply need to sign the form and deliver it to the probate court overseeing your case.

How Long Do You Need the Bond?

The court will release the bond once the personal representative has paid all debts, distributed all assets, and provided a final accounting approved by the court. The personal representative must submit an annual accounting to the court if the estate settlement extends beyond a year. 

After obtaining the notice of release, the personal representative simply needs to email a copy to probate@jetsurety.com so that we can cancel the bond and issue any applicable refund due back to the personal representative.

Can the Tennessee Personal Representative Bond Be Canceled?

If the court accepts the request, we will cancel your bond and send you a refund for any unearned premium. We will refund any unearned premium charged after the first year of the bond on a prorated basis.

What Actions of a Personal Representative Can Lead to Surety Bond Claims?

Personal representatives have a critical role in the settlement of an estate and are relied on by the heirs, creditors, and the probate court to fulfill these obligations. Anyone appointed as a personal representative must adhere to all court orders and ensure they fulfill all responsibilities outlined in Title 30 of the Tennessee Code. 

Some examples of potential actions that could cause a claim:

An heir or creditor to the estate with proven damages caused by the actions of the personal representative may file a claim against their bond. While most personal representatives act with good intentions, occasional mismanagement or errors in accounting can lead to significant challenges for well-intentioned fiduciaries. To avoid these issues, we highly recommend that personal representatives retain the services of an attorney to assist in managing the case.

What Happens if a Claim Is Filed on the Probate Bond?

Upon receiving court notice of a claim on the bond, Jet has 30 days to pay the claim or ask for additional time to review it. Jet works tirelessly to protect our clients against faulty claims, so even if the court has requested a bond payout, we assess all documentation provided by the court and the fiduciary before paying out the claim. However, if a claim is valid and Jet pays the claimant, the personal representative must reimburse Jet.

In consideration of the SURETY issuing, renewing or substituting said bond(s), I, individually and as the owner or officer of the bonded entity, hereby understand and agree, as follows: (i) to reimburse, hold harmless, and indemnify SURETY upon demand for all loss, liability, claim, expense, including but not limited to attorneys’ fees, expert’s fees, investigative fees and claims handling fees, and any other cost which SURETY shall pay or incur in defense, adjustment, or settlement of such claims/suits by reason of such suretyship; (ii) that an itemized statement of loss and expenses by SURETY shall be indisputable proof of my liability to SURETY; (iii) coverage is subject to a $100 deductible; (iv) the employee must be convicted before coverage will apply (v) performance and any form of dispute resolution of this agreement shall take place in the county of SURETY's office of service; and (vi) a facsimile copy or electronically signed version of this agreement shall be binding as if it were an original. This agreement shall survive any changes in, substitute to or renewal of the bond(s).
